Cal/OSHA cited your employer. Now what?
A safety citation is not money in your pocket, and many are reduced on appeal. What it can be is evidence. If you were injured at work in California, a workplace injury lawyer looks at a citation as a signal that the strongest remedies in work-injury law deserve a fast look, because their deadlines are measured in months. Below, California workplaces cited for serious safety violations, from the state's enforcement records.

If you were hurt: serious and willful misconduct and the 50 percent increase
When your injury resulted from your employer's serious and willful misconduct, Labor Code section 4553 increases every workers' comp benefit you receive by one half. The law bars insurance from covering the increase, so it comes out of the employer's own pocket.
A safety-order violation is the designed path to proving it. Section 4553.1 lets the appeals board rest the finding on a violated safety order when the employer knew the order and the conditions that made it apply. The standard is honestly demanding. Courts call it quasi-criminal, and a citation alone does not carry it. But an employer cited for serious violations connected to your injury is exactly the situation the statute was written for.
The catch is the clock. A section 4553 claim must be filed within 12 months of the injury, and unlike most comp deadlines, it does not pause while benefits are being paid. Workers lose this remedy by waiting far more often than by losing the argument. If someone besides your employer shares fault
Workers' comp is usually your only remedy against your own employer. Against anyone else who contributed to your injury, a general contractor, an equipment manufacturer, a property owner, you can bring a full lawsuit, and that is where a safety violation becomes most powerful.
The California Supreme Court held in Elsner v. Uveges (2004) 34 Cal.4th 915 that Cal/OSHA standards may establish the duty of care in any negligence case. Under Evidence Code section 669, a violation that caused the kind of harm the standard exists to prevent creates a rebuttable presumption of negligence. A third party case can recover what comp never pays, including pain and suffering, full lost earnings, and in egregious cases punitive damages. The clock is generally 2 years from the injury.
The narrow paths to suing your own employer are worth knowing too. Fraudulent concealment of an injury and its work connection, a willful physical assault, a knowingly deguarded power press, or an employer that carried no comp insurance at all each opens the courthouse door, and each is very much a facts question for a free case review.
If you spoke up and paid for it
California protects workers who report unsafe conditions, refuse genuinely dangerous work, or file a comp claim. Labor Code section 6310 covers safety complaints, and section 132a covers punishment for a comp claim, adding a benefits increase and reinstatement with lost wages.
These clocks run about a year, and the cases are built on timelines. You reported something, and shortly after, hours got cut, discipline appeared, or the job ended. Common questions
My employer was cited by Cal/OSHA after I was hurt. Does that win my case?
No, but it can matter a great deal. A citation by itself is not a finding you can take to the bank, and many citations are contested and reduced. What a citation does is point at the two remedies worth evaluating fast: a 50 percent increase in workers' comp benefits for serious and willful employer misconduct, and a negligence presumption if someone other than your employer shares fault for your injury.
What is the serious and willful misconduct increase?
Labor Code section 4553 increases all of your workers' comp benefits by one half when your injury resulted from your employer's serious and willful misconduct, and the law forbids insurance from covering it, so the employer pays personally. The standard is demanding. A safety order violation helps prove it but is not enough alone. The deadline is 12 months from the injury, and it does not pause.
Can I sue my employer directly over a safety violation?
Usually not. Workers' comp is generally your only remedy against your employer, even for serious violations. The exceptions are narrow, including fraudulent concealment of an injury, a willful physical assault, a knowingly deguarded power press, and an employer with no comp insurance at all. Where an exception fits, a civil case can recover damages comp never pays.
What if someone other than my employer caused my injury?
That changes everything. Against a third party, such as a general contractor, an equipment maker, or a property owner, you can bring a full injury lawsuit, and a violation of a Cal/OSHA standard can create a presumption of negligence in that case. Third party cases run on a 2 year clock and can include pain and suffering, which comp does not pay.
I reported unsafe conditions and got punished for it. What are my rights?
Labor Code section 6310 protects you when you complain about safety or refuse genuinely unsafe work, and section 132a adds protection once you have a comp claim, with a benefits increase, reinstatement, and lost wages. These clocks run about a year, and retaliation cases often turn on the timeline between your report and what happened to you, so write the dates down now.
Do workers get any part of a Cal/OSHA fine?
No. Penalties go to the state. But safety requirements live in the Labor Code, which means affected workers may pursue PAGA civil penalties on top of the state's fine, with 35 percent of any recovery shared among the workers. That path has its own one year clock and notice requirements.
